2017 Arts & Crafts/Activities Vendor Terms and Conditions

Oktoberfest 2017 is a family friendly event which works to ensure there are a variety of items that are affordable by the general community. Items must appeal to a general audience and along with pricing, be approved in advance-no commercial items. Oktoberfest 2017 may remove any items it deems not acceptable or are outside of the pre-approved description provided. Items considered inappropriate include but are not limited to: Pornographic material; Items encouraging alcohol or drug use or the use of weapons; Racist or sexist material; Vulgar or abusive language; Political or cause marketing. Sales permits and collection of all appropriate sales tax and any labeling required by law is the sole responsibility of the vendor.
All vendor sites have been specifically laid out to ensure equitable sight lines and to facilitate the flow of pedestrian traffic. Vendors may not intrude into the pedestrian traffic area and will remain within the parameters you applied for. If you choose to occupy more space than you requested and previously paid for, you will be charged immediately, for the larger space. This fee is due immediately or you will be required to remove product from the extra space.
BOOTH PLACEMENT PRIORITY
Booth placement will be based on space and sight lines as determined by event organizers. Subletting the whole or any part of the space hereby contracted for is not permitted. Oktoberfest 2017 reserves the right to relocate vendors. Please note live or recorded music will not be permitted. Entertainment will be produced from designated stages.
BOOTH SET UP AND STRIKE
Each vendor will set up and maintain, market, operate, take down and remove their own booth materials from the space provided to them. Load in details will be forthcoming. TEAR DOWNS ARE NOT PERMITTED PRIOR TO 6PM on Saturday, October 21, 2017.
SITE PREPARATION – NO VEHICLES ALLOWED INSIDE THE VENDOR AREA.
PLEASE MAKE LOADING AND UNLOADING PREPARATIONS FROM THE DROP OFF AREA ONLY. VOLUNTEERS MAY NOT BE AVAILABLE.
Participating vendors must be covered with a $2 Million Insurance Policy and provide FAMC with a Certificate of Insurance naming, Folk Arts Multicultural Centre (FAMC), Port Dalhousie Business Association and the City of St. Catharines as additional insured to the commercial liability rider of the vendor’s policy.
RECYCLING, GARBAGE AND SITE CLEAN UP
Vendors are responsible to sort and classify all garbage for recycling. Vendors must leave their sites as they found it, clear of all garbage and recyclable materials. Failure to do so may result in additional charges to help offset the clean-up costs incurred by Oktoberfest 2017. Event garbage cans and recycling bins will be maintained on a continuous basis throughout the program times. Upon completion of the event, vendors are responsible for removing their equipment and waste and returning their site to its pre-event condition. This must be completed upon the closing of Oktoberfest 2017 on Saturday, October 21 by 9:00 pm. Oktoberfest 2017 organizers are not responsible for any loss or damage to the site.
PARKING PERMITS AND DRIVING RULES
Pedestrian and community safety along with Oktoberfest 2017 image is our highest priority. Driving inside the vendor area AT ANY TIME is banned and there will be a limited space and time duration for the Vendor Drop off area. Any vendor who breaks the parking and driving rules may have their space cancelled without notice and their fee forfeited as liquidated damages to the event. Vehicles illegally parked during the Event may be ticketed and towed at the expense and liability of the registered owner. There isn’t any designated vendor parking, though all Municipal parking lots and parking meters are free from Friday 6pm until Monday 6am.
WEATHER and/or CANCELLATION
Please note that every effort shall be made to operate the event. Should Oktoberfest 2017 deem it necessary to cancel or alter the operation of the event, Oktoberfest 2017 will not provide refunds or any compensation for loss of income.
AGREEMENT TO MARKET
Each vendor will endeavour to market their participation in Oktoberfest 2017 to their network to help increase attendance in coordination with the event when possible.
Each vendor indemnifies Oktoberfest 2017, its management team, its volunteers, Folk Arts Multicultural Centre, the Port Dalhousie Business Association and the City of St. Catharines from any litigation resulting from any loss or damage that they may incur to them as a result of their being accepted and operating a booth at Oktoberfest 2017 for any reason. Oktoberfest 2017 is not responsible for any loss or damage as a result of vandalism or an act of God.
At this time, vendors should be prepared to have minimal electricity provided or available. Certified generators and batteries or battery powered lighting, provided by the vendor is acceptable, (NO open flames), but must be approved by the event organizers prior to October 1, 2017. Electricity details will be forthcoming over the summer and will be communicated to all vendors.
